Supreme Court on Thursday ruled that President Trump is not immune from the local law enforcement.
President Trump’s advocates had argued that he did not need to comply with a New York grand jury subpoena since he is the sitting President.
The Chief Justice John G. Roberts Jr. said that Manhattan District Attorney Cyrus R Vance had the right to investigate Trump’s personal and financial records.
This is a landmark decision because it reinstates the limits of Presidential authority and its immunity from criminal proceedings.
Trump Vs Vance
The Trump vs Vance case involves a subpoena that Manhattan Attorney District Attorney and New York’s top prosecutor Cyrus Vance issued to Mazars USA.
Vance is currently investigating into President’s business dealings because of the revelation of his hush-money payments to two women.
The two women, Karen McDougal, a former Playboy model and Stephanie Clifford, a pornographic film actress, allegedly had sexual affairs with President Trump in the past.
Vance had been seeking the financial records and tax returns from Mazars USA, President Trump’s accounting firm since 2011.
President and his attorneys had tried to dismiss Grand Jury subpoena. They argued that since Mr Trump is sitting President, he has absolute immunity from criminal proceedings.
Chief Justice, however, rejected this argument.
President is not immune from criminal proceedings
Chief Justice John Roberts cited two hundred years old doctrine to reject claims of President Trump’s lawyers.
He wrote, “Two hundred years ago, a great jurist of our Court established that no citizen, not even the President, is categorically above the common duty to produce evidence when called upon in a criminal proceeding.”
Vance called the decision a tremendous victory for the nation’s system of justice and its founding principle that “not even President, is above the law.”
Vance said that the investigation will resume guided by “grand jury’s solemn obligation to follow the law and the facts”.
President Trump did not take this lightly and reacted to the investigations which were “all a political prosecution” on Twitter.
“I won the Mueller Witch Hunt and others, now I have to keep fighting in a politically corrupt New York. Not fair to this Presidency or Administration!” he said
